1. travel contract
1.1 The General Terms and Conditions apply to transportation carried out by Holiday Shuttle 2.0, Seigweg 343, 5753 Saalbach from Salzburg Airport, Munich, Innsbruck and Vienna to Saalbach/Hinterglemm, Viehhofen, Maishofen, Zell am See, Kaprun, Saalfelden, Leogang, Maria Alm, Fieberbrunn, Kitzbühel and Gastein.
1.2 The transfer booking is binding after the order has been placed and payment carried out by credit card. Collateral agreements that do not correspond to the content of the transfer order are subject to special approval from Holiday Shuttle 2.0.
1.3 Holiday Shuttle 2.0 is a joint venture of local taxi operators, see Details
1.4 The terms of the travel agency branch are applicable.
2.1 Payment is made only via Internet with credit card (VISA or Mastercard) on the Holiday Shuttle 2.0 website and is binding. The payment confirmation slip containing the booking number is a valid ticket for the Shuttle from the Airport to the hotel as indicated.
2.2 Acceptance of the General Terms and Conditions constitutes the conclusion of a legally binding contract.
2.3 The current prices for the transfers indicated can be found on the website www.holiday-shuttle.at
and apply for one person unless otherwise stated.
3.1 The payment confirmation containing the number of the booking must be presented before transportation begins. If this is not available the transfer can be refused. The customer is wholly responsible for carrying the necessary travel documents with him.
3.2 Departure is directly from the customers hotel which must be quoted in detail to avoid confusion due to similarities in hotel names. At the given time the customer should wait at the hotel entrance. Pick-up takes place within approx. half an hour. If the customer is not there the transfer departs. In such a case no refund is made.
3.3 The departure must be booked by the customer to permit the transfer to arrive on time at the Airport under normal conditions. Approximately 3,5 hours before the flight departs from Airport Salzburg and approximately 5,5 hours before the flight departs from Airport Munich should be allowed and a longer transfer time can be expected on Saturdays and holidays especially in winter season due to heavy traffic and hold-ups. The customer should take this into consideration at the time of booking. See also Paragraph 4.
4. Modification, Changes in Booking, Cancellation:
4.1 Booking closes 12 hours before the transfer with our lineshuttle and 24 hours before with our VIP transfer. The reservation is only valid for the transfer booked and for the person named in the booking.
4.2 Transfers that are not made use of, if not proberly cancellation, become invalid and the transfer price is not refunded (for example: flight cancellation). A future claim for services is not permissible.
4.3 Should the transfer be subject to considerable difficulty for reasons beyond the control of Holiday Shuttle 2.0 (avalanches, landslides, etc), become dangerous or impossible, Holiday Shuttle Ges.m.b.H. & Co KG is entitled to cancel the transfer and the costs of the transfer will be refunded to the passenger. No later claim can be made.
4.4 Holiday Shuttle 2.0 is entitled to cancel the transfer if the transfer is endangered through any action or negligence on the part of a passenger or if there is danger of harm to other passengers sharing the transfer due to such action or negligence. In this event Holiday Shuttle Ges.m.b.H. & Co KG refunds the transfer costs to this passenger. No further claim exists.
4.5 Holiday Shuttle 2.0 reserves the right to carry out minor changes to the transfer if necessary and to such extent that these do not result in major changes to transfer times.
4.6 Cancellation fees: to 48 hours - 10%, after that - 100%
4.7 Changes can be made by the customer before the booking deadline itself with booking number and pin code through our website. For the secrecy of the pin code the customer himself is responsible.
4.8 If a flight is delayed the customer must inform the Holiday Shuttle Ges.m.b.H. & Co KG hotline immediately and prior to the transfer so that the reservation can be changed to one of the next possible transfers (it is only possible if one of next the shuttles is booked of 1 person in advance, otherwise the shuttle doesn't run, or if there is some space in the car). If information is not received in time no further claim to a transfer can be made. No refund will be paid.
VIP Shuttle will wait 1 hour without extra cost, from the second hour € 30,-/hour will be charged. This would then be paid directly to the driver in cash.
4.9 The Holiday Shuttle 2.0 departure times are scheduled to allow sufficient time to reach flights when the reservation is made correctly, however they do not take delays into consideration. Should delays occur due to hold-ups, accidents, congested road and airport traffic, diversions etc., particularly on Saturdays, Holiday Shuttle 2.0 cannot be held responsible for arriving in time for flights. Eventual delays, particularly on Saturdays, must be taken into consideration when booking.
4.10 Holiday Shuttle 2.0 endeavours to convey the customer to his/her accommodation by the most direct route without any detours to other destinations. Should organizational reasons or adverse weather conditions make it impossible to drive directly to the accommodation, Holiday Shuttle 2.0 will arrange a direct transfer to the hotel and it may be necessary to change vehicles. Any accommodation must however be accessible by normal public roadways. If a change of vehicle is necessary no extra cost is incurred. A refund cannot be claimed.
5.1 Travel cancellation insurance is not included in the transfer price, is however recommended by Holiday Shuttle 2.0.
6.1 The driver is obliged to observe all safety measures required to ensure a safe journey. In particular whether and how the journey will be carried out and above all the loading and unloading of the luggage requiring transportation.
6.2 It is the customers responsibility to check that his/her luggage is loaded into the vehicle and later unloaded. Luggage is generally transported in the same vehicle. Should it for any reason what ever not be possible to transport the luggage in the same vehicle, it will be transported to the passenger's hotel by one of the next transfers. Luggage will be delivered within 6 hours of arrival. In this event no expenses will be refunded.
6.3 If luggage is not packed appropriately for transport the driver is entitled to refuse to convey the luggage.
6.4 Holiday Shuttle 2.0 does not accept liability for any damage to luggage caused by other items of luggage.
7. Transportation of Children and Frail Persons.
7.1 According to the laws governing the conveyance of passengers, all persons (0 to 99 years old) must occupy a seat of their own during transportation. This is a general charge. If seats for children are required, please inform us at the time of booking. We only offer booster seats, no baby or child seats.
7.2 If there is risk of danger for the transfer due to the fact that a guest represents a danger to himself on the grounds of his physical or mental state, no liability can be accepted for bodily damage, including death.
8. Refusal of Conveyance
8.1 Holiday Shuttle 2.0 can refuse transportation in the event of any of the following circumstances:
> The promotion would represent a danger for the safety or the health of the other passengers or of the driver or would represent an unreasonable burden.
> The mental or physical state of a passenger, and especially any impairment arising from alcohol or drug abuse, represents a danger or risk to the passenger him/herself, to the other passengers or to the driver.
> The passenger is not able to present either confirmation of the reservation or a reservation number.
9. participation obligation
9.1 The customer is obliged to make any complaints known to the local driver immediately. The driver is instructed to resolve the situation as far as possible. Should a passenger negligently fail to inform the driver of any discrepancy, no claim for reduction of costs can be considered.
10. Complaints Procedure, Time Limit for Claims, Statutory Period of Limitation
10.1 If a fault has not be wholly or partly remedied, a report must be written in cooperation with the driver. The customer must assert claims against Holiday Shuttle Ges.m.b.H. & Co KG for transfers not carried out according to the agreement. Any claims must be made in the written form.
10.2 The statutory period of limitation for claims relating to transfer that has not been conducted in accordance with the agreement is 4 months after the transfer has been mutually agreed.
11. Data Protection and Data Safety
11.1 Personal date such as name, address, credit card details are necessary for the reservation. The data supplied is processed electronically, saved and forwarded within the limitations of the purpose of the agreement. Data relating to persons is protected by the federal laws governing data protection.
12.1 Holiday Shuttle 2.0 accepts no liability for direct or subsequent damage unless there is evidence that this has been caused due to negligence or intent on the part of Holiday Shuttle 2.0. In no event will the amount exceed the sum of the damaged proved.
12.2 Should international agreements or regulations based on such provide for restrictions of liability for services carried out on behalf of Holiday Shuttle Ges.m.b.H. & Co KG, Holiday Shuttle 2.0 can refer to such in the event of damages.
13. Legal Domicile
13.1 Any disputes arising from this agreement will be settled before the Court of Law in Saalfelden.
14. Other provisions and agreements
14.1 These terms apply unless individual agreements are entered into.
14.2 The above terms apply only if legal provisions enforced after the time of printing do not provide for other regulations.
14.3 If any of the terms become ineffective, this does not affect the agreement as a whole.
